Vacancy in World Intellectual Property Organisation: Legal Officer - 23363-FT / Business Development and Digital Content Disputes Section, WIPO Arbitration and Mediation Center, IP and Innovation Ecosystems Sector.

Coordinating with other vertical and horizontal WIPO sectors, the IP and Innovation Ecosystems Sector (IES) is responsible for helping Member States develop their IP and innovation ecosystems to drive enterprise and economic growth. IES is also responsible for providing support for researchers and innovators, as well as enterprises, including SMEs, in IP commercialization and otherwise using IP for business growth; issues relating to the emergence of IP as an asset class; and the development of advisory expertise in these and related areas, for example, in national IP strategies.

Within IES, the position is located in the Business Development and Digital Copyright and Content Disputes Section of the WIPO Arbitration and Mediation Center, which is a resource center for the resolution of IP disputes between private parties through alternative dispute resolution (ADR) methods. The Center's areas of activity are covered by the External Relations Section, the IP Disputes Section, the Business Development and Digital Copyright and Content Disputes Section, and the Internet Dispute Resolution Section.

The incumbent provides legal and technical inputs to support the identification of new ADR opportunities that inform the Center's strategic direction, including by analyzing data related to IP disputes, engaging with public and private stakeholders, and participating in the development of effective tools to streamline WIPO's IP dispute resolution services. The incumbent also contributes to the development and implementation of ADR options for copyright- and content-related disputes, and the administration of such disputes.

Ombudsman inquiry on Commission President’s text messages is a wake-up call for EU

The European Ombudsman inquiry into the Commission’s handling of a request for text messages between its President and the CEO of a pharmaceutical company is a wake-up call for all EU institutions about ensuring accountability in an era of instant messaging. One year after the initial request by a journalist, the Commission has still not clarified whether messages reported to concern major vaccine procurement deals exist and whether the public is entitled to see them. The Ombudsman had asked the Commission, in a finding of maladministration in January, to conduct a more thorough search for the text messages. Balancing Crime Control and Ne Bis In Idem: ECtHR Finds No Violation in Successive Proceedings

The case concerned the right not to be tried or punished twice – a right protected by Article 4 of Protocol No. 7 and known as the “ne bis in idem” principle. In its Grand Chamber judgment in the case of Jesus Pinhal v. Portugal (applications nos. 48047/15 and 2276/20) the European Court of Human Rights held, by fifteen votes to two, that there had been no violation of Article 4 of Protocol No. 7 (right not to be tried or punished twice) to the European Convention on Human Rights. Spain: Three convicted for €3.8 million agricultural subsidy fraud in first verdict after trial in Spanish courts

A company and two of its legal representatives were convicted for a €3.8 million subsidy fraud involving agricultural funds, in the first verdict delivered after a trial by Spanish courts, following an investigation by the European Public Prosecutor’s Office (EPPO) in Madrid (Spain). The Central Criminal Court of Spain sentenced the two defendants to one year's imprisonment and a fine of €3 million. The court also fined the company €3 million and imposed a three-year ban on receiving public subsidies or public funds. In addition, the company will have to reimburse €2 million in funds illegitimately obtained, and the company directors were held to be joint and severally liable. In 2018, the company applied and obtained a subsidy from the Spanish Agricultural Guarantee Fund (SAGF) for the improvement of its facilities for the production of fruit and vegetables.
