United Nations Office for Project Services seeks Senior Legal Advisor for its office in Copenhagen, Denmark.

UNOPS (United Nations Office for Project Services) in Copenhagen, Denmark is an operational arm of the United Nations – supports the achievement of the Sustainable Development Goals (SDGs) by successfully implementing its partners’ peacebuilding, humanitarian and development projects around the world.

The Legal Group

The Legal Group (LG) advises UNOPS management, project offices, regional offices and other specialized units within UNOPS on institutional, commercial, and administrative law matters.  Legal Advisors at UNOPS provide legal advice in the areas of public international law, dispute resolution, commercial law and administrative law.  This legal advice covers a wide range of topics, including host-country agreements and privileges and immunities, disputes with external parties, administrative/HR law matters, engagements, partnership agreements, grants, procurement contracts and set-up of hosted initiatives, joint programmes and multi-donor trust funds, and collaboration with outside counsel, pro bono law firms and the UN Office of Legal Affairs (OLA), where required.

About the Role

The Senior Legal Advisor, Commercial has the primary responsibility of supervising the commercial law team in providing guidance and authoritative interpretations as required on project agreements, legal policies and procedures.

Reporting into the General Counsel (GC), the Senior Legal Advisor, Commercial exercises their accountabilities with designated authority provided by the GC and in accordance with the instructions established by the GC.

The Senior Legal Advisor, Commercial demonstrates a good understanding of the operational context in which UNOPS operates and leads the provision of review and advice on commercial law matters, assuming direct responsibility for especially complex and sensitive matters, as necessary.  

The Senior Legal Advisor, Commercial supervises and oversees legal aspects of UNOPS’ commercial operations (including activities concerning engagements, procurement contracts, grant agreements, partnership agreements, and setting-up of hosted initiatives, joint programmes and multi-donor trust funds).

The Senior Legal Advisor, Commercial works with a high degree of independence, and is expected to travel from time to time.

ECtHR Judgement against Greece: Disclosure of the identities and medical data of prostitutes diagnosed with HIV was a breach of their right to private life

The case of O.G. and Others v. Greece (applications nos. 71555/12 and 48256/13) concerned the publication, by decision of the domestic authorities, of medical data concerning prostitutes who had been diagnosed as HIV-positive, and media coverage of them. In Chamber judgment in the case of Efstratiou and Others v. Greece (application no. 53221/14) the European Court of Human Rights held, unanimously, that there had been no violation of Article 6 (right to a fair trial / right of access to a court) of the European Convention on Human Rights. The applicants in this case considered that the refusal by the court of appeal and the Court of Cassation to take account of evidence which they considered as decisive for the outcome of the case had been excessively formalistic. Those courts had considered that the documents in question had not been presented to the court of appeal in accordance with the requirements of Article 240 of the Greek Code of Civil Procedure. Obligation on publisher of the Daily Mail to pay substantial “success fees" in defamation and breach of privacy cases was excessive. Consumer credit agreements: In the event of failure to comply with the obligation to provide information, a bank may be deprived of its right to interest

The Court of Justice in its Judgment in Case C-472/23 (Lexitor) regarding the consumer credit agreements, ruled that, in the event of failure to comply with the obligation to provide information, a bank may be deprived of its right to interest.  This may be the case even where the individual seriousness of the infringement of that obligation and its consequences for the consumer are likely to vary from case to case. Lexitor is a Polish debt collection agency to which a consumer assigned rights arising from a credit agreement concluded with a bank. That company claims that the bank failed to fulfil its obligation to provide information to the consumer when the agreement was concluded.
