Associate Lawyer - Specialized in Regulatory and Governance Matters at EIB

The EIB, the European Union's bank, is seeking to recruit for its Legal Directorate (JU) – Legal Department, Corporate (CORP) – Regulatory Matters Division (REG) at its headquarters in Luxembourg, a (Associate) Lawyer - Specialized in Regulatory and Governance Matters. This is a full - time position at grade 4/5. The term of this contract will be 4 years. Panel interviews are anticipated for end February 2022.

The EIB offers fixed-term contracts of up to a maximum of 6 years, according to business needs, with a possibility to convert to a permanent contract, subject to organisational requirements and individual performance.

The successful candidate will deliver the legal services required by the Bank in the area of EU and international banking and financial regulations and institutional law, including in relation to prudential and governance regulatory requirements and rules. Deadline for applications: 31st January 2022.

Convention for the Protection of the Profession of Lawyer has been opened for signature

The Council of Europe Convention for the Protection of the Profession of Lawyer has been opened for signature on the occasion of the meeting of Council of Europe Foreign Ministers organised in Luxembourg on 13-14 May. This is the first-ever international treaty aimed at protecting the profession of lawyer in a context of increasing reports of attacks on the practice of the profession, whether in the form of harassment, threats or attacks, or interference with the exercise of professional duties. The  Convention  has been signed by Andorra, Estonia, France, Greece, Ireland, Italy, Lithuania, Luxembourg, Netherlands, North Macedonia, Norway, Poland and Sweden. Implementation of the European Court's judgments: New decisions adopted by the Committee of Ministers

The Council of Europe’s Committee of Ministers has published the  case-by-case decisions  taken during the Committee’s meeting from 20 to 22 September 2022 to supervise the implementation of judgments and decisions from the European Court of Human Rights. The Committee of Ministers adopted 31 decisions concerning 19 member states during the meeting, including Interim Resolutions in the  Mammadli v. Azerbaijan  group of cases and the  Georgia v. Russia (I)  case. 72 Final Resolutions were adopted by the Committee in respect of 137 judgments and decisions from the European Court, concerning 28 different member states. €5 million fine against Spotify for GDPR violations

Swedish Authority for Privacy Protection (IMY) issued an administrative fine against Spotify for shortcomings regarding transparency. The General Data Protection Regulation, GDPR, entered into force in 2018 and means, among other things, that the rights of individuals are strengthened. One such right is the right of access, which means a right for individuals to find out what personal data a business handles about the person in question and to receive information about how this data is used. Due to complaints that the Swedish Authority for Privacy Protection (IMY) received against Spotify AB regarding the right of access, IMY has audited how Spotify handles the right for individuals to access their personal data. School Fined for Unlawful Biometric Data Processing

An Italian high school was fined by the data protection authority for using a fingerprint-based attendance system for administrative staff. The authority found the system lacked a legal basis and that employee consent was not a valid justification due to the power imbalance between employer and employee. Following a complaint, the Italian Supervisory Authority (SA) - Garante found out that a high school adopted a biometric recognition system that, in order to detect presence in office and prevent damage and vandalism, required the use of administrative staff's fingerprints. The workers involved were those who had given their consent and did not wish to use traditional methods of attesting their presence at the office.
