The European Ombudsman inquiry into the Commission’s handling of a request for text messages between its President and the CEO of a pharmaceutical company is a wake-up call for all EU institutions about ensuring accountability in an era of instant messaging. One year after the initial request by a journalist, the Commission has still not clarified whether messages reported to concern major vaccine procurement deals exist and whether the public is entitled to see them. The Ombudsman had asked the Commission, in a finding of maladministration in January, to conduct a more thorough search for the text messages. The Commission’s recent response failed to say whether it had looked directly and correctly for the text messages and if not, why not. While the response recognised that work-related text messages can be EU documents, it reiterated that the Commission’s internal policy is, in effect, not to register text messages. CJEU Ruling C-57/23: Police May Rely on Internal Rules to Store Suspect Data

Judgment of the Court of Justice in Case C-57/23 (Policejní prezidium): The police of a Member State may decide, on the basis of internal rules, whether it is ecessary to store the biometric and genetic data of a person accused or suspected of a criminal offence.  Where national law sets appropriate time limits for a review of the need to store those data, it does not necessarily need to provide for a maximum period of storage . A Czech public official was interviewed by the police in the context of criminal proceedings involving him. Despite his objections, the police ordered the taking of his fingerprints, the taking of a buccal smear on the basis of which the police established a genetic profile, the taking of photographs and the drawing up of a description of him. Protection of Lawyer Profession: Parliamentary Assembly gives green light to new Council of Europe treaty

Parliamentary Assembly has warmly welcomed the draft  Council of Europe Convention for the Protection of the Profession of Lawyer , pointing out that lawyers play a key role in administering justice and ensuring public confidence in the law. Approving an opinion based on a report by Vladimir Vardanyan (Armenia, EPP/CD), the Assembly said lawyers are increasingly becoming targets of harassment, intimidation and attacks. The new Convention requires states to protect them in various ways, allowing them to practise without fear of discrimination or interference. It also establishes standards for professional associations of lawyers and sets up a robust monitoring mechanism. However, the Assembly regretted the lack of specific provisions on the use of secret surveillance against lawyers, and called for the addition of a clause specifically prohibiting states from entering reservations to the Convention, to ensure it is fully implemented. Judicial Workload and Compensation: EU Law Does Not Mandate Extra Pay for Covering Vacant Posts (CJEU)

Judgment of the Court of Justice in Case C-272/24 (Tribunalul Galați) on 13.11.2025: A judge who carries out tasks which fall to a vacant post at his or her court, in addition to those within the remit of the post to which he or she has been appointed, is not necessarily entitled to financial compensation. The grant of a rest period to compensate for the additional work is, under certain conditions, an adequate measure. The Galați Regional Court (Romania) is understaffed due to various judicial posts remaining vacant. A judge who has been working at that court since 2017 took the view that, since 2019, he has performed not only the tasks associated with his own post, but also, in part, those tasks linked to vacant posts.  Being of the opinion that he has worked overtime, that judge requested that he be remunerated for it. International Criminal Court terminates proceedings against Al-Tuhamy Mohamed Khaled following notification of his death

On 7th September 2022, Pre-trial Chamber I of the International Criminal Court (ICC) terminated proceedings against the alleged former Lieutenant General of the Libyan army and former head of the Libyan Internal Security Agency, Mr Al-Tuhamy Mohamed Khaled.  The Chamber made this decision following the Prosecution’s Notification of the Death of Al-Tuhamy and request to withdraw arrest warrant, dated 2 August 2022 and annexing a copy of a death certificate issued by the Libyan authorities and an official translation. In light of the Prosecution’s submissions, the Chamber considered that the certificate sufficed to render the warrant of arrest without effect. Outstanding requests for arrest and surrender made to any States will accordingly be withdrawn. Instead, the regulation of gambling services, including betting, remains largely within the competence of individual Member States.  This results in a diverse and often fragmented legal framework across the EU. While the EU facilitates some level of cooperation and sets overarching principles, the specifics of licensing, operational requirements, and consumer protection measures vary significantly from country to country. Despite the lack of a unified framework, several key principles and EU-level instruments influence the national regulations of betting companies.
